A person may make a complaint to the health ombudsman about a service provided by a health practitioner or a health service organisation. A person may make a complaint to the health ombudsman: orally, including by telephone; or in writing, including by email or other electronic means – see section 33 of the Act. The health ombudsman may assess a complaint to decide the most appropriate action to take, pursuant to section 14 of the Act. The health ombudsman may conciliate a complaint, which may lead to the parties entering a confidential legally binding settlement. A regulation may prescribe a code of conduct, charter, standard or other document to provide guidance to health service providers, persons receiving health services and entities performing functions under this Act about the standard of services that should be provided by health service providers or a related matter. For a listing of current prescribed conduct documents, refer to regulation 5 of the Health Ombudsman Regulation 2014. For the definition of ‘health service provider’, refer to section 8 of the Act.

Reason for law

To protect the health and safety of the public; and to promote: professional, safe and competent practice by health practitioners; and high standards of service delivery by health service organisations; and to maintain public confidence in the management of complaints and other matters relating to the provision of health services. (Section 3)
