A civil action (set out in section 4 and not falling foul of section 7) may be commenced in the Magistrates Court where the amount claimed is not more than $150,000.

  • Sections 2, 4, 5, 6, 7, 11, 16, 54

A party to a proceeding may appear in person or by a lawyer or with the leave of the court, another person.

  •  Sections 18

A person dissatisfied with a decision of the Magistrates Court may apply for a new trial (within 7 days).

  • Section 44

A person dissatisfied with a judgment or order of the Magistrates Court may appeal to the District Court. Note: Leave to appeal may be required where the amount claimed is below the minor civil dispute limit.
